BLM/BIA Ownership Reports and Title Research
Researching Bureau of Land Management (BLM) and Bureau of Indian Affairs (BIA) regulated interest can be difficult and time consuming. It is easy to forget to check the BLM and BIA records after checking the courthouse. Often times the title records and the records of the courthouse do not match. Title records are maintained at various regional offices and are often difficult to access. Due to increased penalties and timing issues, it is very important to determine early in your project if you have BLM or BIA regulated tracts in your unit. BLM/BIA Title Curative
The Bureau of Land Management and The Bureau of Indian Affairs do not recognize assignments or other documents filed at the county courthouse. These agencies only recognize transactions filed on the correct form and approved by their office. Many operators and working interest owners overlook this fact when conducting transactions that affect BLM/BIA managed tract. Due to the massive amount of mergers and acquisitions which take place in the oil and gas industry, units that contain BIA or BLM tracts often have title deficiencies. Prior to purchasing BLM/BIA regulated lands, Reagan Smith will ensure that due diligence is performed with the proper agencies records. Designation of Successor Operator
Designation of Successor Operator forms are required by the Bureau of Land Management when an operator wishes to assign a Communitization Agreement. This only applies when an operator is assigning all of their operations and their entire interest in the unit covered by the Communitization Agreement. Designation of Operator
If an operator intends to operate a well on Bureau of Indian Affairs regulated lands and is not a working interest owner in the BIA lease, the operator must obtain consent from at least 51% of the working interest owners in the BIA lease. The working interest owners designate the operator of BLM Designation of Operator forms and file with the appropriate office. The Bureau of Indian Affairs and Bureau of Land Management do not recognize assignments or other documents filed at the county courthouse. Regulatory Due Diligence Reports
Operators are faced with a multitude of regulations from county, state and federal governments for each well they drill. Reagan Smith Energy Solutions, Inc. produces Regulatory Due Diligence Reports which provide a detailed account of how to comply with all regulations that may affect each well. The report includes a list of all permits required and the agencies from which to obtain the permits. The report also addresses timing issues with regards to permitting and provides solutions to avoid any obstacles that could arise.
